Terms and Conditions
Effective Date: February 20th, 2025
These Terms and Conditions (“Agreement”) govern the rental of equipment (“Rental Equipment”) from EZER Delivery (“the Company”, “we”, “our”, or “us”) to the customer (“Customer”, “you”, or “your”). By renting equipment from our website or through any other means, you agree to abide by the terms outlined herein.
1. Rental Agreement
1.1. The Company agrees to rent the Rental Equipment to the Customer for the rental period specified at the time of booking.
1.2. The Customer acknowledges that they are renting the Equipment and agrees to return the equipment by the agreed-upon return date and in the same condition it was rented, subject to normal wear and tear.
2. Payment Terms
2.1. The Customer agrees to pay the rental fees specified on the website or as otherwise agreed upon at the time of booking.
2.2. All payments for rentals are due in full at the time of booking or as otherwise agreed. Payment methods accepted include credit cards, debit cards, or other methods specified by the Company.
2.3. The Customer authorizes the Company to charge for any damages or theft as outlined in Section 4.
3. Customer Responsibility
3.1. The Customer is responsible for the care and safekeeping of the rented equipment during the rental period.
3.2. The Customer agrees to use the Rental Equipment only for its intended purpose and in accordance with any provided instructions, manuals, or safety guidelines.
3.3. The Customer agrees not to alter, repair, or modify the Rental Equipment without prior written consent from the Company.
4. Damages and Theft
4.1. The Customer is fully responsible for any loss, theft, damage, or destruction of the Rental Equipment that occurs during the rental period, regardless of fault.
4.2. In the event of damage or theft, the Customer agrees to promptly notify the Company and provide a detailed report of the incident.
4.3. If the Rental Equipment is damaged beyond repair, lost, or stolen, the Customer agrees to reimburse EZER Delivery for the full replacement cost of the equipment, plus any applicable shipping, handling, and administrative fees.
4.4. The Customer agrees to allow the Company to charge the provided payment method for the cost of damages, theft, or non-return of the equipment, including any associated fees.
4.5. Any repairable damage will be charged to the Customer based on the cost of repair and any necessary administrative or handling fees.
5. Insurance and Liability
5.1. EZER Delivery does not provide insurance for the Rental Equipment unless otherwise agreed in writing. It is the Customer’s responsibility to ensure the equipment is adequately insured, if desired.
5.2. The Customer agrees to indemnify and hold harmless EZER Delivery, its employees, agents, and affiliates from any and all claims, damages, liabilities, and costs arising from the use of the Rental Equipment, including any damage to persons or property.
6. Return of Equipment
6.1. The Customer agrees to return the Rental Equipment in the condition it was rented, subject to normal wear and tear.
6.2. Failure to return the Rental Equipment by the agreed-upon return date will result in a full day’s additional rental cost being charged to the Customer.
6.3. The Company reserves the right to charge additional fees if the equipment is not returned by the specified date, including a full day’s rental cost for each day the equipment is overdue.
6.4. Returning the Rental Equipment means the Customer has made the equipment available for pick-up by an EZER Delivery driver at the designated pick-up address provided by the Customer at the time of booking. The Customer must ensure that the equipment is accessible and ready for collection at the agreed-upon time.
7. Right to Refuse Service
7.1. EZER Delivery reserves the right to refuse service or cancel any rental agreement at its discretion, including but not limited to situations where the Customer fails to provide valid payment or identification.
8. Governing Law
8.1. This Agreement shall be governed by and construed in accordance with the laws of the State of Maryland. Any legal action or proceeding under this Agreement shall be brought exclusively in the District Court of Maryland for Anne Arundel County, within the City of Annapolis.
9. Miscellaneous
9.1. The Company reserves the right to update or modify these Terms and Conditions at any time without prior notice. All changes will be effective immediately upon posting to the website.
9.2. If any provision of this Agreement is found to be invalid or unenforceable, the remainder of the Agreement will remain in full force and effect.
9.3. This Agreement constitutes the entire understanding between the parties and supersedes all prior agreements or understandings, whether written or oral.
By renting the Rental Equipment, the Customer acknowledges that they have read, understood, and agreed to the terms and conditions outlined above.
